Upcoming Event: Join us on May 15–16, for a two-day workshop, co-hosted with the Competitive Enterprise Institute, on the constitutional limits of the FTC, DOJ and FCC to address censorship and speech. The FTC is exploring its authority on political bias in content moderation and advertiser lawsuits, as is the DOJ Antitrust Division, while the FCC is investigating broadcaster bias and reinterpreting Section 230. Our workshops will address the authority of these agencies and how the First Amendment limits government interference in private media.
FCC: We filed reply comments in the FCC’s “Delete, Delete, Delete” Docket. Building on our original comments, we cautioned the Commission to solicit public comments before deleting rules, as required by the Administrative Procedure Act. The reply comments were featured in Radio & Television Business Report.
Age Verification: On a new Tech Policy Podcast, Eric Goldman of Santa Clara Law discusses his new paper, “The ‘Segregate-and-Suppress’ Approach to Regulating Child Safety Online.” New legislation introduced today would mandate age verification by app stores, which is unconstitutional for reasons Berin explained last year when similar legislation was introduced.
Antitrust: On the latest episode of our Rethinking Antitrust podcast, Martin Gaynor, former Director of the FTC Bureau of Economics, joins the podcast to discuss the state of competition in health care markets, recent FTC and DOJ health care initiatives, and offers suggestions for new initiatives.
