Fallout from the Taamneh and Gonzalez Rulings
Plus our remarks at the FTC and Montana’s TikTok ban
Section 230: Berin, Corbin, and Ari hosted a Twitter Space to share their reactions on last week’s Supreme Court ruling in Twitter v. Taamneh and Gonzalez v. Google.
Ari also participated in a media briefing to explain the legal ramifications of the Court’s decisions. Our collective analysis was quoted in Variety and Broadband Breakfast, and cited in Lawfare.
FTC: We transcribed and edited our remarks at the recent FTC Open Meeting, where we made the case that more public input and discussion are needed for sweeping new regulations.
Corbin was quoted in Global Competition Review (paywall) on the FTC’s early efforts to oppose due process challenges to the way the Agency keeps its own administrative court: “I think the FTC is trying to take a ‘kill it with fire’ approach,” he said.
Antitrust: In Barron’s (paywall), Bilal discussed why regulators are too dismissive of the potential benefits of DNA-sequencing provider Illumina’s attempted acquisition of Grail, a cancer testing company.
Montana: Last week, Montana became the first state to ban TikTok. Ari was quoted in Reason about this First Amendment test case waiting to happen.
EU Policy: Berin and Andy submitted a response to the European Commission’s request for consultation on the future of the electronic communications sector and its infrastructure.
Data Protection: This week, Berin is attending the annual Computers, Privacy & Data Protection (CPDP) conference in Brussels. His running commentary on Twitter addresses the critical issues being discussed.
Where the big fight waits for another day.
