FCC’s Proposed AI Rules: Playing Dodgeball with the First Amendment
Plus age verification, serial acquisitions, and more…
Upcoming Event: Next Wednesday, October 2 at 1:00 p.m. ET, we’ll launch the third installment of our “Tech in the Courts” series, presented collaboratively with Washington Legal Foundation. Ari will moderate a panel discussing online child protection measures and First Amendment rights, focusing on age verification policies.
AI: We filed comments with the FCC on their proposed rules for AI-generated content in political advertising. The Commission unconstitutionally targets political speech, lacks the authority to regulate AI, and proposes an overly broad definition of AI that would trigger warning labels for any ad that uses commonplace “computational technologies” like Photoshop.
Antitrust: Bilal filed comments on the FTC and DOJ's request regarding serial acquisitions, emphasizing the positive impact these strategies can have on innovation and competition.
Age Verification: We joined an amicus brief urging SCOTUS to overturn the Fifth Circuit’s ruling upholding Texas’s HB 1181, a law that unconstitutionally restricts adult access to protected adult speech.
Podcast: On a new Tech Policy Podcast, Sayash Kapoor (Princeton University) discusses his fantastic new book, AI Snake Oil: What Artificial Intelligence Can Do, What It Can’t, and How to Tell the Difference.
Appearances: On his Substack, Corbin recaps his speaking engagements over the summer, including a FedSoc event on the Murthy v. Missouri ruling, his TPI Aspen Forum panel on administrative law, and more. (Another shout-out to Karina Branson for her artistic rendering of Corbin’s Aspen panel!)
That’s a bold strategy, Cotton.
Let’s see if it pays off for them.
