FTC Has No Authority to Regulate Online Speech Abroad
Plus the DSA, FSC v. Paxton, and more...
Free Speech: Before a hearing on “Europe’s Threat to American Speech and Innovation,” Berin sent a letter to the House Judiciary Committee rebutting the FTC’s assertions that moderating U.S. content to comply with foreign laws is “unfair or deceptive.” The letter was formally entered into the hearing record.
DSA: Berin also joined more than 30 EU and US scholars in a letter debunking claims that the Digital Services Act is a censorship law (it’s content neutral) and that it censors US speech (it applies only inside the EU). The same scholars sent a letter to EU Commissioner Henna Virkkunen asking her to further implement the Commission’s commitment to the principle of content-neutrality in the DSA, and against extra-territorial effect.
Age Verification: On the latest Tech Policy Podcast, Corbin discusses why Free Speech Coalition v. Paxton is wrong, how it muddies First Amendment law, and how it is already causing wider harm.
Google Antitrust Case: On the Ross Kaminsky Show, Corbin explained why the latest Google search antitrust ruling is a win not only for Google but for free-market competition.
FTC: Andy’s essay in WLF Legal Pulse, describing how the Eighth Circuit struck down the FTC’s Click to Cancel Rule, was prominently mentioned in last week’s GWU Regulation Digest newsletter.
