Broadband Regulation: Berin and Jim filed comments in response to the FCC’s NPRM proposing to claim broad powers over broadband Internet access service (BIAS) by classifying it as a telecommunications service under Title II of the Communications Act. We explain why the Commission has no such authority.

Section 230/AI: Ari led a broad coalition of free speech, civil liberties, and tech policy organizations in a coalition letter to express concerns about the “No Section 230 Immunity for AI Act” (S. 1993). Ari also wrote a thread on the bill and his letter received lengthy coverage in Techdirt.

Antitrust: Bilal filed comments to the Korea Fair Trade Commission—an agency similar to our FTC—on proposed amendments to their merger review guidelines.
Last week, Bilal also filed an amicus brief urging the U.S. District Court for the Southern District of New York to evaluate the FTC’s request for a preliminary injunction consistent with the full burden-shifting framework of Baker-Hughes for the acquisition of Propel Media, Inc., by IQVIA Holdings Inc.
Social Media Legislation: The press release for our amicus brief in the Supreme Court NetChoice cases was quoted in Broadband Breakfast. “Only the state can ‘censor’ speech,” Corbin said. “And these states are doing so by trying to co-opt websites’ right to editorial control over the speech they disseminate.”
AI Speech: Mondaq mentioned Ari’s interview with Roll Call following his testimony on AI and election-related speech. “If you think [deceptive ads are] a problem then it would make sense to address it, whether it’s created by AI or not,” Ari said. “I’m not sure it makes sense to address it only when an ad is generated by AI.”
Governing broadband is a question for democratically elected representatives.
