The FTC Has the Tiger by the Tail
Plus age estimation, Chevron, KOSA, and more . . .
FTC: As Berinʼs latest comments explain, facial age estimation (FAE) may offer reasonable age assurance as part of COPPA’s online parental consent regime, but the technology can’t provide the age verification needed to reliably distinguish adults from minors, as contemplated by bills like the Kids Online Safety Act (KOSA).
In City Journal, Corbin wrote about several recent antitrust reversals for the FTC and what might be in store for the Commission: “In other, still-pending cases, the FTC has the tiger by the tail,” he wrote. The piece was also highlighted in RealClearMarkets.
Podcast: On the latest Tech Policy Podcast, Corbin hosted Elizabeth Slattery and Will Yeatman, senior legal fellows at Pacific Legal Foundation, to discuss the rise, fall, and possible end of Chevron deference. See our recent amicus brief for our take.
KOSA: Last week, our quote in Reason from Berin and Ari’s letter about KOSA was also picked up by Los Angeles Daily News, Daily Breeze, Pasadena Star-News, and many more.
On August 29, Ari will participate in a session for the Media Law Resource Center (membership required) to analyze the sweeping legislative proposals—like KOSA—intended to “protect” children online.
Free Speech for Minors: Live tweeting (Xing?) from the TPI Aspen Forum, Ari corrected the record: “[M]inors have First Amendment rights to speak and receive info . . . . The burden is on [the] government to prove a compelling interest” when it wants to restrict minors’ speech and access rights.
We’ve got him now.
