FCC: We filed comments in the FCC’s “Delete, Delete, Delete” docket, cautioning against hasty decisions and urging the Commission to continue to seek notice and comment from the public, even when it thinks that might not be required by the Administrative Procedure Act (APA). Doing so will help the agency defend its actions in court, especially given the Supreme Court’s Loper Bright decision, which ended Chevron deference to agencies’ interpretations of ambiguous statutes.
